I don’t what it is in store for you in the first-semester legal and ethics class, but the New York Post has presented a classic case study with its weekend stories alleging the housekeeper in the DSK case is a prostitute who had traded sex for money while working at the hotel and even while under protection of the Manhattan DA.
Here is the first story in a series of pieces by the Post. Check out the sourcing, or the lack thereof. A friend of mine who used to hold a high level job at the Post tells me the reporter is a well respected journalist who can be trusted to adhere to professional standards. I guess we will see about that.
In the meantime, the woman has responded with a libel suit against the Post.

I really can’t believe that reporter did that! What makes a journalist want to post something without sources? I think that unfortunately, even though she is a reputable journalist, her career is over.
Classic tabloid style. One week DSK is being bashed by the Post, now the accuser’s getting the same treatment. The sources in both the Times portrait of the accuser and this story seem to be willing to say whatever the reporter wants, be it positive or negative. It makes me wonder if these so-called sources actually knew the accused at all, or are just making wild claims.
If there’s anything to take issue with in this story, it’s the reporter’s opinion that “bombshell disclosures will likely force the DA to drop all charges against the banking big shot.” A more objective analysis might say that the DA will have a harder time getting a conviction with a less sympathetic accuser.

It will be unfortunate if Cyrus Vance decides to drop the case now. I thought he would at least finish what he started given that certain details are still true. The forensic evidence shows there was intercourse so the possibility that it wasn’t consensual is still there. It’s too bad that we have to assume only certain kinds of people can be raped or don’t deserve to be raped and therefore determines how we prosecute people. I understand that her credibility is damaged once she’s lied about something but I doubt it’s the first time an alleged victim of any kind has had a past or bad connections revealed during a trial. Our justice system shouldn’t have to consider this woman to be an angel or Strauss-Kahn to be a monster in order for this case to proceed.
